Welcome to TruckingTalent.com (“Trucking Talent,” “we,” “us,” or “our”).
These Terms of Use (“Terms”) govern your access to and use of the Trucking Talent website, platform, and related services (collectively, the “Platform”).

By creating an account, accessing, or using the Platform, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.
If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 18 years old to use the Platform.
By creating an account, you represent and warrant that you meet this requirement.

2. Nature of the Platform

Trucking Talent is an online platform that connects truck drivers (“Drivers”) with trucking companies and other employers (“Employers”) for recruiting and hiring purposes.

Trucking Talent is not:

• an employer,
• a staffing agency,
• a broker,
• or a party to any employment agreement between Drivers and Employers.

All hiring decisions, communications, and employment relationships are solely between Drivers and Employers.

3. Account Registration and Verification

To access certain features, you must create an account and provide accurate and complete information.

You agree to:

• provide truthful and up-to-date information,
• maintain the confidentiality of your login credentials,
• promptly update your information if it changes.

We may require verification of your email address and/or phone number.
Failure to verify may limit or prevent access to certain features.

We reserve the right to suspend or terminate accounts that contain false, misleading, or fraudulent information.

4. Driver Profile Information

Drivers may be asked to provide required and optional information, including but not limited to:

• contact information,
• CDL experience,
• job preferences,
• location data,
• compensation expectations,
• safety and experience-related information.

Some information is required to activate a profile; other information is optional and provided at the Driver’s discretion.

Drivers are responsible for the accuracy of all information submitted.

5. Profile Types: Basic and Matched

Drivers may choose one of the following profile types:

a. Basic Profile

By selecting a Basic Profile, the Driver authorizes Trucking Talent to make their profile information, including contact details, available to Employers immediately after profile activation.

b. Matched Profile

By selecting a Matched Profile, the Driver’s contact information remains hidden.
Employers may request to connect with the Driver, and contact information will be shared only if the Driver affirmatively approves the request.

Drivers may change their profile type subject to platform rules.

6. Consent to Use and Share Information

By creating and activating a profile, you authorize Trucking Talent to collect, process, and share your information as described in these Terms and the Privacy Policy.

Drivers acknowledge that:

• profile information may be shared with Employers for recruiting and hiring purposes,
• sharing occurs at the Driver’s direction and in connection with job opportunities,
• consent may be withdrawn at any time by contacting us or deleting the account.

Employers agree to use Driver information solely for recruiting and hiring purposes and not to resell or misuse such data.

7. Communications and TCPA Consent

By providing a phone number, you acknowledge that Trucking Talent may send transactional or service-related messages, such as verification codes or account notifications.

Marketing, recruiting, or job-related calls or messages (including automated messages) will be sent only if you provide separate, affirmative consent.

You may opt out of non-essential messages at any time by following the instructions provided in the message.

8. Acceptable Use

You agree not to:

• use the Platform for unlawful purposes,
• misrepresent your identity or qualifications,
• scrape, harvest, or misuse data from the Platform,
• interfere with the Platform’s operation or security,
• attempt to access accounts or data without authorization.

Employers agree not to:

• use Driver data for purposes unrelated to hiring,
• resell or redistribute Driver information,
• discriminate in violation of applicable laws.

9. Intellectual Property

All content, software, designs, and trademarks on the Platform are owned by or licensed to Trucking Talent and are protected by applicable laws.

You may not copy, modify, distribute, or create derivative works without our prior written consent.

10. Suspension and Termination

We may suspend or terminate access to the Platform at any time if:

• these Terms are violated,
• information provided is false or misleading,
• required by law or regulatory authorities.

You may delete your account at any time.
Termination does not affect rights or obligations accrued prior to termination.

11. Disclaimer of Warranties

The Platform is provided “AS IS” and “AS AVAILABLE.”
We make no warranties regarding:

• job availability,
• hiring outcomes,
• accuracy of Employer or Driver information,
• uninterrupted or error-free operation.

12. Limitation of Liability

To the maximum extent permitted by law, Trucking Talent shall not be liable for:

• indirect, incidental, or consequential damages,
• employment decisions or disputes between Users,
• unauthorized access or misuse of data by third parties.

Our total liability shall not exceed the amount paid by you, if any, to use the Platform during the preceding twelve months.

13. Indemnification

You agree to indemnify and hold harmless Trucking Talent from any claims, damages, or liabilities arising out of:

• your use of the Platform,
• your violation of these Terms,
• your interactions with other users.

14. Arbitration and Class Action Waiver

Any dispute arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration, conducted on an individual basis.

You waive the right to participate in any class or representative action.

15. Governing Law and Venue

These Terms of Use and any dispute arising out of or relating to the Platform or these Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.

To the extent that any dispute is not subject to arbitration, you agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of such courts.

16. Changes to These Terms

We may update these Terms from time to time.
Material changes will be posted on the Platform. Continued use constitutes acceptance of the updated Terms.
